ORDER

Mr. Justice H.S. Brar, President—A prayer has been made in this application to condone the delay of 218 days in filing the appeal. The only ground for condoning delay taken up in this application is that the applicant is a poor lady and was not able to contact her Counsel at Chandigarh as she was not having money with her to file the appeal and when the money was arranged the appeal was filed.

2. First of all, it has not been mentioned in the application as to when she arranged the money and when she contacted her Counsel for filing the appeal. Even otherwise poverty is no ground either under the Indian Limitation Act or under the Consumer Protection Act, 1986 to condone the delay in filing the appeal. In this particular case after we perused the impugned order, the District Forum has allowed the applicant-complainant to approach the Civil Court for her grievance, which course she did not adopt for the reasons best known to her. In any case, we do not find any ground to condone the delay of 218 days in filing the appeal.

nsequently, this application is dismissed, however no order as to costs in the special circumstances of the case.

Resultantly, this appeal is also dismissed as b
