Parikh, President—This appeal arises from order dated 13.6.1996 rendered by the learned Consumer Disputes Redressal Forum, Ahmedabad City, Ahmedabad in Complaint No. 8/94 directing the opponent Insurance Company to pay to the complainant Rs. 3,50,000/- with 18% interest from 1.4.1992 till payment and compensation and cost respectively in the sum of Rs. 10,000/- and Rs. 5,000/-. It was the complainant’s case that the complainant’s goods vehicle in question was insured for Rs. 3,50,000/- for the period 20.5.1991 to 19.5.1992 with the opponent Insurance Company. But, unfortunately, it was stolen from Narol, a place in the outskirts of Ahmedabad City on 3.11.1991. Necessary complaint was lodged with the Vatva Police Station and panchnama was also drawn. The vehicle could not be traced out although it was treated as a case of theft against the accused persons, who incidentally happened to be complainant’s driver and cleaner. The complainant lodged complainant’s claim soon after the commission of theft but after considerable amount of delay it was repudiated by letters dated 8.10.1993 and 10.12.1993.
