Mr. R.S. Awasthi, Member—This is an appeal under Section 15 of the Consumer Protection Act, 1986 (the Act) directed against the order passed by the District Consumer Disputes Redressal Forum, Raipur (hereinafter referred to as ‘District Forum’) directing the appellants to pay Rs. 10,00,000 with interest at 9% per annum from the date of repudiation and Rs. 1,000 as cost of complaint.

2. Contention of the complainant is that her deceased husband obtained 2 life insurance policies from the appellant for Rs. 5,00,000 lacs each on 7.7.2001. The policies were issued after medical check up of the complainant’s husband, Ashok Parwani, by Dr. Ashish Malhotra and Dr. Alok Rai. Policy holder Ashok Parwani expired on 7.6.2002 due to cancer of the liver. The claim of the complainant as nominee for the policy amount was repudiated by the appellant on the ground that the deceased was an alcoholic and was suffering from epilepsy, hypertension and diabetes for 15 years at the time of submission of proposal and the fact was not disclosed by him in reply to the questionnaire forming part of the proposal.
