Mr. Justice M.B. Shah, President—This Revision Petition is filed against the interim order passed by the State Commission, Karnataka. At the time of entertaining the appeal, the State Commission, for granting stay of the execution of the impugned order, imposed a condition that petitioner shall deposit 50% of the amount awarded by the District Forum, Bangalore (Urban).
2. Learned Counsel appearing on behalf of the petitioner submitted that under Section 15 of the Consumer Protection Act, 1986, Rs. 25,000 or 50% of the amount as awarded by the District Forum, whichever is less, only, is to be deposited before the State Commission.
3. In our view, there is a total misconception in the aforesaid submission. Proviso to Section 15, inter alia, requires that no appeal by a person, who is required to pay any amount in terms of the order of the District Forum, shall be entertained unless the appellant has deposited 50% of the amount or Rs. 25,000 whichever is less. Depositing the amount of Rs. 25,000 or half of the awarded amount, whichever is less, is for entertaining the appeal by the State Commission.
