ORDER

S. S. Dewan, President-This is a complaint under Section 17 read with Section 12 of the Consumer Protection Act, 1986(for short ‘the Act’).

2. In this case there is no dispute that the Truck bearing Registration No. HR-29A-0553, Model 1991 belonging to the complainant was insured with Oriental Insurance Company Ltd. for short ‘the Insurance Company’ under the comprehensive policy for the period commencing from April 23. 1991 and valid upto April 22, 1992. There is also no dispute that the said truck was purchased at a total cost of Rs. 4,10,000 and the same was insured for the full purchase price under the comprehensive policy. On 14th August. 1991 that is to say during the subsistence of the policy, the truck was set on fire by the militants near village Kukuwala Police Station Dirba, District Sangrur(Pb.) and because of the said incident the truck belonging to the complainant became totally useless and was treated salvage. It transpires that immediately after the incident, the complainant informed the Insurance Company. He also lodged the first information report at Police Station Dirba. It appears that the spot survey was undertaken and the surveyor deputed by the Insurance
