ORDER

S.A. Kader, President-This is a complaint under section 17 read with Section 12 of the Consumer Protection Act.

2. The complainant is an Exporter of Drugs and allied products. M/s. Henley Chemicals Limited, London placed an order on the complainant for the supply of certain pharmaceutical items to be delivered at Douala, Cameroon, Western Africa. The consignment was packed in two wooden cases and delivered to the 1st opposite party, Shipping Company under a Bill of Lading dt. 31.3.93 at Madras to be transported to and discharged at the port of Douala. The complainant sent the Bill of Lading through its local bank, the Punjab National Bank, Madras, which in turn sent it to Midland Bank, London to be negotiated by the buyer. The consignment has been carried to Antwerp in Belgium and transhipped to the 2nd opposite party, Shipping Company to be carried to Douala, Cameroon under a Bill of Lading dt. 11.5.93. This Bill of Lading made it clear that the goods should be released only against the Original Lucky Seaways Bill of Lading. The goods were expected to be delivered within 45 to 60 days at Douala but the goods were not so delivered. On 10.7.93, the local agent of the 1st opposit
