J.N. Srinivasa Murthy, Member — M/s. Chemed Exim Private Ltd. , by its Director, S. Jogaiah, S/o Siddappa of Basaveshwarnagar, Bangalore, has filed this complaint against the Managing Director and General Manager of M/s. Mysore Sales International Ltd., Bangalore, and also Commissioner of Customs, Central Revenue building, Oueens Road, Bangalore, praying for a direction to

the OPs 1 and 2 to pay Rs. 12,82,905/- immediately along with interest for the loss of the valuable cargo imported and deposited with them due to their negligence, with the interest at 24% p.a. from the date of import 4.6.2000 till the date of payment, and exemplary damages of Rs. 5 lakhs for causing mental agony, loss of business with their valued customer, DRDL, Hyderabad, due to non supply of the impugned equipment to them in time,

to the complainant.

2. The brief facts of the complaint are that the above complainant is an importer of sophisticated electronic equipment for being supplied to the

Defence Research and Development Laboratory (DRDL), Hyderabad, and to other defence establishments in the country. He received an order from the DRDL, Hyderabad, No. 180 dt. 21.6.1999, for the supply of 100 acceler
