JUDGMENT

Salma Noor, Member—The main question which arises out of this appeal is that whether the respondents/complainants Sh. Davindra Nath Sethi & Anr. are Consumers? In order to answer the above said question it would be worthwhile to state facts of this case.

2. The respondents herein were the complainants before the Ld. District Forum. Respondents/complainants had filed a complaint before the Ld. District Forum, Kashmere Gate, Delhi wherein respondents/complainants alleged that they had booked a 400 Sq. Ft. flatted Factory space on the first floor at DCM Techno Plaza with the site at Plot No. 20, Delhi Cloth Mills Complex, DCM Road, Bara Hindu Rao, Delhi. The respondents/complainants had paid a sum of Rs. 2,27,000/- to OP-2. On 14.01.1996 the unit was allotted to the respondents/complainants @4,500/- per Sq. Ft. at a total cost of Rs. 22,03,750/-. Respondents/complainants had alleged that along with the receipt dated 14.01.1996 the appellant/OP-1 had provided to the respondents/complainants the payment schedule. As per the said schedule the respondents/complainants were to make quarterly payments of 5% of the price of unit of the installments which ultimately had to be conclud
