R.K. Batta, Presiding Member - The complainant had applied for institutional plot on 24.7.1990 in Sector 32, Gurgaon and a plot No. 19 area measuring 2100 sq. mts. was allotted to him on 8.5.1992 on payment of total price of Rs. 31,50,000 at the rate of Rs. 1,500 per sq. mt. The last payment instalment wise was paid on 3.5.1994 amounting to Rs. 5,90,625 but the opposite party did not deliver the possession of the plot. Accordingly, the complainant had approached the District Forum for directions to the opposite party to deliver the possession of the plot in question to him and to pay interest on the amount already deposited with the opposite party from the date of deposit till the actual payment is made or to allot an alternate plot on the same terms and conditions whether in the same sector or in the adjoining sector.

2. The opposite party, namely, the petitioners had raised 14 preliminary objections. On merits, it was stated that the complainant did not deposit the enhanced cost of the plot within 30 days, as intimated to him vide memo No. 8133 dated 28.9.1995.
