ORDER

B.C. Kandpal, President - This is an appeal under Section 15 of the Consumer Protection Act, 1986 against the order dated 1.12.2010 passed by the District Forum, Haridwar in consumer complaint No. 342 of 2010. By the order impugned, the District Forum has allowed the consumer complaint ex parte against the appellant-opposite party and directed the appellant to pay a sum of Rs. 1,35,000 to the respondent-complainant.

2. Briefly stated, the facts of the case as mentioned in the consumer complaint, are that the complainant had deposited sum of Rs. 1,28,115 with the appellant on 30.7.2009 for admission in M.B.A. course, but the complainant did not attend the class. The complainant requested the appellant for refund of the amount deposited by him, but to no avail. The complainant sent a notice to the appellant on 2.8.2010, but the amount was not refunded. Alleging deficiency in service on the part of the appellant, the complainant filed a consumer complaint before the District Forum, Haridwar.
