ORDER

J. Bag, Member - The present appeal is directed against the Order dated 7.2.2008 passed by the learned District Consumer Disputes Redressal Forum, North 24 Parganas in their D.F. Case No. 62/2007 by which a petition of complaint filed under Section 12 of the C.P. Act, 1986 was allowed with the direction upon the O.P. to pay a sum of Rs. 1,00,000 (One lakh) only towards compensation for causing harassment, mental agony, loss of business and litigation cost within a period of 30 days from the date of communication of the order.

2. The complaint case, in brief, was as follows:

The Complainant took a loan of Rs. 6,30,000 (six lakh and thirty thousand) only in June 2004 for the purchase of a TATA LPT TRUCK (Model 1613 TURBO). The Complainant came to know from the Statement of Account regarding the re-payment schedule that the total liability of Rs. 8,32,652 (Eight lakh thirty two thousand six hundred and fifty two) only against the said loan of Rs. 6,30,000 was to be cleared in 47 EMIs. The Complainant started paying EMIs regularly, but subsequently, owing to bad patch of his business he being unable to pay EMIs, approached one cousin named Sanjit Kr. Dutta Biswas to take charge of
