ORDER :
1. The opposite party is the appellant. The respondents filed complaint claiming return of gold ornaments pledged by them after receiving the balance amount and to pay compensation and costs.
2. The respondents by pledging 330 gms of gold ornaments availed loan of Rs. 95,000/- from the appellant on different dates. The respondents requested the appellant to return the gold ornaments on the premise that they are ready to pay the entire amount. The appellant postponed to return the gold ornaments despite repeated demands made by the respondents. The respondents got issued notice on 24.08.2010 to the appellant and the same was returned with an endorsement “unclaimed.”
3. The appellant was set ex-parte.
4. The respondent No.1 filed his affidavit and the documents Exs.A1 to A14.
5. The District Forum allowed the complaint directing the appellant to return the gold ornaments after receipt of Rs. 1,01,925/- from the respondents.
6. Aggrieved by the order of the District Forum, the opposite party filed the appeal contending that the cause title in the complaint did not show any name of the party or representative/proprietor. The address of the appellant on the notice and in the publicati
