Mr. N.P. Kaushik, Member (Judicial )—Present complaint has been filed by Master Amresh Kumar Thakur on 13.5.2003 when he was a minor and aged 12 years. Complaint was filed through his father/ guardian Sh. Jagdish Thakur. Complaint is directed against Dr. Ajay Kumar Sinha, physician (in short OP1) working in Vimhans Hospital, Nehru Nagar, New Delhi (in Short OP2 hospital). Facts as disclosed in the complaint are that the complainant who was suffering from vomiting and fever was brought to emergency ward of OP2 hospital on 28.4.2001 at about 10.30 a.m. The doctor on duty named Dr. Bernard administered one spoon of the syrup ‘phenargan’ to the complainant. After sometime, OP1 Dr. Ajay Kumar Sinha gave injection ‘phenargan’ IV, 25 mg in the brachial artery. Injection was given intra arterially instead of the same being given intra venously. Soon thereafter the complainant started complaining of acute pain. At about 4 p.m. complainant was discharged from OP2 hospital and taken to home.
