M.R. Shah, J.—Rule. Mr. KP Raval, learned Assistant Government Pleader waives the service of notice of rule on behalf of the the State - Respondent No. 1 and Mr. V.M. Pancholi, learned Advocate waive the service of notice of rule on behalf of respondent named Mr. J.M. Chaudhary and Mr. NS Sheth, Learned Advocate, waive the service of notice of rule on behalf of respondent named Mr. DJ Bharvad, in both the petitions.

Application No. 13045 of 2006 has been preferred by the petitioner – Vijay Hathising Shah - original accused No. 1, under section 482 of the Code of Criminal Procedure to quash and set aside further proceedings of the M.Case No. 2 of 2006 registered against him with the CID (Crime), Gandhinagar Zone Police Station. It is further prayed to quash and set aside Criminal Case No. 226 of 2006 filed by the original complainant – Respondent No. 3, pending in the Court of Chief Judicial Magistrate, Ahmedabad Rural for the offences punishable under Sections 467, 468, 471, 114, 120B read with Section. 34 of Indian Penal Code.
