JUDGMENT :

J.B. Pardiwala, J.

1. I am tempted to preface this judgment with the following observations made by a Division Bench of this Court.

"There are many enactments in this country intended to serve the purposes of extending the welfare measures to the working class. Merely enacting the laws would not be an adequate protection or extension of a necessary benefit. Such laws have to be implemented with a sense of commitment. That largely depends on who apply the law and how they handle it. That also depends, quite often, on the degree of efficiency of the persons administering the law and the capacity to take decisions one way or the other expeditiously. Time is of the essence and delay will destroy the advantage conceived by the extension of the benefits of such welfare measures."

2. The writ-applicants before me are the retrenched employees of the Palanpur Nagarpalika. They were serving on different posts. Their services came to be terminated in the year 2007. They seek to invoke the extra-ordinary jurisdiction of this Court under Article 226 of the Constitution of India wit
