JUDGMENT :

K.M. THAKER, J.

1. Heard Mr. Clerk, learned advocate for the petitioner and Mr. Chauhan, learned advocate for the respondent.

2. The petitioner has challenged the award dated 30.8.2010 passed by learned Labour Court at Anand in Reference (LCA) No. 41 of 2004 whereby learned Labour Court has partly allowed the reference and while denying the relief prayed for by the petitioner i.e. direction to the respondent to reinstate him with consequential benefits, learned Labour Court has instead, awarded lump sum compensation to the tune of Rs.8,000/-. Aggrieved by the said award and direction the petitioner filed present petition and prayed that the respondent should be directed to reinstate him with consequential benefits.

3. So far as factual background is concerned it has emerged from the record and submissions by learned advocates that the petitioner was employed by the respondent during the period between May 1997 to March 2003. The petitioner herein raised industrial dispute on the allegation that his service was illegally terminated and he demanded that he should be reinstated in his service with consequential benefits.
