1. Heard Ms.Kruti Shah, learned advocate for the petitioner and Ms.Maithili Mehta, learned APP for the respondent – State through Video Conferencing.
2. RULE. Ms.Mehta, learned APP waives service of notice of rule on behalf of the respondent – State. With the consent of learned advocates for both the sides, rule is fixed forthwith
3. The present petition has been filed under Articles 226 and 227 of the Constitution of India and under Section 482 of the Criminal Procedure Code for the following reliefs.
[B] Issue appropriate writ, order or direction for release of vehicle bearing registration Truck No.GJ-21-V-6406 which is seized as muddamal in FIR C.R.No.III-153 of 2019 registered at Billimora Police Station, District Navsari, on 01.03.2019 for the offence punishable U/Ss. 65(A)(E), 116-B, 81, 98(2) of Prohibition Act by quashing and setting aside the order dated 01.08.2019 passed by Addl. Chief Judicial Magistrate, Gandevi, District Navsari below application u/s. 451 of Code of Criminal Procedure;
[C] Grant such other and further relief as thought fit in the interest of justice;
