HIGH COURT OF GUJARAT
MR. JUSTICE ANIRUDDHA P. MAYEE, J
NASIRUDDIN AKBARBHAI VHORA – Appellant
Versus
UNION OF INDIA – Respondent
CIVIL APPLICATION (FOR ORDERS) NO. 1 of 2025 In R/SPECIAL CIVIL APPLICATION NO. 10268 of 2022

Petitioner Advocates:MR.D K.PUJ(3836) ,Respondent Advocate: NOTICE SERVED BY DS(5)

Court permits travel abroad for a loan defaulter director, emphasizing balance of convenience and absence of criminal charges.

Headnote:

(A) Recovery of Debts Due to Banks and Financial Institutions Act, 1993 - SARFAESI Act - Application for permission to travel abroad - Applicant, a director of a defaulter company, seeks permission to travel for business despite outstanding dues - Court allows travel on conditions including deposit of Rs.10,00,000/- and submission of itinerary - Balance of convenience favors the applicant as no criminal case is pending against him. (Paras 2, 10)

(B) Lookout Circular - The issuance of lookout circulars is to prevent defaulters from evading legal proceedings, but must be justified in context - Mere default does not automatically justify restriction on travel. (Paras 6, 10)

Facts of the case:
The applicant is a director of Parvin Exim Pvt. Ltd., declared a defaulter by the Opponent Bank with outstanding dues of over Rs.12 Crores. The applicant has previously traveled abroad for business without issues. (Paras 2, 4)

Findings of Court:
The application for travel is granted under specified conditions, balancing the applicant's business needs against the bank's interests. (Paras 10)

Issues: Whether the applicant can travel abroad given the outstanding loan and the conditions imposed by the bank. (Paras 5, 9)

Ratio Decidendi: The court emphasized that the applicant's previous compliance with travel conditions and lack of criminal antecedents justified allowing travel, balancing rights and equities favorably for the applicant. (Paras 10)

Result: Application allowed with conditions.
