JUDGMENT:- This is an appeal filed against the order of the Subordinate Judge (II), Manipur, in Civil Miscellaneous Case No.34 of 1959, directing under S.25 of the Guardians and Wards Act, on title application of the respondent that the minor Paramjit Singh will be placed in the custody of his father Chanan Singh, the respondent herein and that the appellant Jaswant Kaur, the mother of the said minor should deliver the child to the father Chanan Singh.

2. Chanan Singh and Jaswant Kaur were married in 1944 and the minor boy Paramjit Singh was born in March, 1952. They belong to Punjab and they are Sikhs by religion. Chanan Singh with his family came over to Imphal some years ago and was staying in the house of his brother-in-law Santah Singh at Maxwell Bazar and Chanan Singh was carrying on business having some public carrier lorries. One Chinglen Singh (D.W.3) was the driver of one of the lorries of Chanan Singh.

3. It is clear from the evidence in the case that Jaswant Kaur did not like that Chanan Singh should reside in the house of Santah Singh.
