WP(C) No.2817 Of 2023, WP(C) No.3499 Of 2023
Decided On : 12-08-2024

Advocates Appeared:
For the Petitioners:Mr. M. Nath, Advocate Mr. S. Banik, Advocate Advocate
For the Respondents:Mr. S.R. Talukdar, Advocate, Mr. J.M.A. Choudhury, Advocate, Mr. A.R. Bhuyan, Advocate

IMPORTANT POINT
The Court established that strict adherence to procedural timelines in election disputes under cooperative society rules is essential for maintaining the integrity of the electoral process.

Headnote:

Cooperative - Election Dispute - Assam Cooperative Societies Act, 1948; Assam Cooperative Societies Election Rules, 2019 - The Court interpreted the provisions regarding election disputes and the timeline for raising grievances, concluding that the petitioners failed to comply with the mandated procedures, leading to the dismissal of their petitions.

Fact of the Case:

The case involved a dispute over the election and AGM of the Gandhigram Cooperative Society, where the petitioners challenged the election results citing defective electoral rolls, despite not being parties to the original notice of election.

Finding of the Court:

The Court found that the petitioners did not challenge the election notice and failed to submit their grievances within the stipulated time frame as per the Rules of 2019, thus their representation was invalid.

Issues: Whether the petitioners' grievances regarding the election results were valid given their failure to comply with the procedural requirements set forth in the Assam Cooperative Societies Election Rules, 2019.

Ratio Decidendi: The Court held that compliance with the procedural requirements of the election rules is mandatory, and failure to adhere to the timelines for raising disputes renders any subsequent claims invalid.

Result: Both writ petitions are dismissed.
