JUDGMENT

Shamsuddin, J.

The defendants in O.S. No. 319 of 1981 on the file of the Court of Subordinate Judge of Kozhikode, are the appellants.

1.The said suit was filed by the Respondent herein for cancelling the order passed by the Commissioner, Hindu Religious and Charitable Endowment (Administration) Department, Calicut in Appeal No. 2 of 1981.

2. The facts leading to the filing of the above suit may be summarised as follows:-According to the Plaintiff, he is the present karanavar of the ancient Thiyya family called Kuniyil family in Calicut and the family house is located in Kuniyilparamba. In a portion of the said paramba shown as A Schedule to the plaint, there is a temple called Kuniyil temple described in the plaint B Schedule belonging to the family of the Plaintiff. The Plaintiff became the karanavan in 1948 and since then be was in possession of the property including the temple, and prior to him, the prior karanavans of the family were in possession and enjoyment of the property including the temple. The presiding deity of the temple is God Siva. There are no properties attached to the temple and the Kuniyil family is to give the required funds for all necessary expenses of
