Judgment

S.P. Pathak, J.-Appellant Vijendra Kumar has filed this appeal under Section 374(2) CrPC against the judgment of conviction and order of sentence dated 21.07.2003 passed by learned Addl. District and Sessions Judge (Fast Track) No.1, Doongarpur in Sessions Case No. 26/2002, whereby the appellant has been convicted and sentenced as under:-

Under Section Punishment498-A, IPC Three years’ simple imprisonment and fine of Rs. 500/-, in default of payment to further undergo three months’ simple imprisonment

304-B, IPC Seven years’ simple imprisonment and fine of Rs. 1000/-, in default of payment to further undergo six months’ simple imprisonment

Both the sentences were ordered to run concurrently and the accused-appellant was allowed benefit of set off under Section 428 CrPC.

2. Briefly stated, the facts of the case are that an application Exhibit-P/1 was filed by PW 1 Bhagwatilal, father of deceased Neetu, before the SDM, Doongarpur, stating therein that he had married his daughter Neetu with accused Vijendra kumar about three months back in village Bankoda as per the traditions of their caste on 01.06.2001 and out of the said period of three months she alongwith her husband stay
