Fact of the Case:
Petitioner, a Technical Assistant in the Department of Chemistry, University of Rajasthan, was appointed as Senior Technician, FT-NMR on an ad hoc basis for six months with the approval of the Vice-Chancellor. After the expiry of the term, the University decided not to extend his appointment due to representations from other Technical Assistants and the fact that the post was not advertised for regular selection. The petitioner challenged this decision, arguing that it was arbitrary and violative of his right to continue in service till the availability of a regularly selected person.
