RAJASTHAN HIGH COURT
P.C.Jain, J.
Bhikharam and another - Appellant
Versus
Shantilal - Respondent
S.B. Civil Revision Petition No. 1104 of 1997.
Decided On : 26-03-1998
The appellate court should not ordinarily admit additional evidence before the appeal is heard, but it may do so if the appellant satisfies the court that after the exercise of due diligence such evidence was not within his knowledge or could not be produced when the appeal was decided against him.
Headnote:
ORDER 41 RULE 27 CPC - ADDITIONAL EVIDENCE - ADMISSIBILITY - RECEIPT - REGISTRATION CERTIFICATE - WITNESS - RE-EXAMINATION - REJECTION OF APPLICATION - REVISION PETITION - DIRECTIONS TO APPELLATE COURT.
Fact of the Case:
Petitioners filed a revision petition against the order of the District Judge rejecting their application under Order 41 Rule 27 CPC to produce additional evidence in an appeal. The petitioners sought to produce a receipt, registration certificate, and witness statement to prove their tenancy in a shop.
Finding of the Court:
The High Court held that the appellate court erred in rejecting the admissibility of the receipt without considering the merits of the case. However, the court upheld the rejection of the application to re-examine the witness and postpone the decision on the admissibility of the remaining documents until the hearing of the appeal.
Issues: 1. Whether the appellate court erred in rejecting the admissibility of the receipt without considering the merits of the case? 2. Whether the appellate court erred in rejecting the application to re-examine the witness? 3. Whether the appellate court erred in postponing the decision on the admissibility of the remaining documents until the hearing of the appeal?
Ratio Decidendi: 1. The appellate court should not have pronounced its decision on the admissibility of the receipt without considering the merits of the case. 2. The appellate court did not err in rejecting the application to re-examine the witness. 3. The appellate court did not err in postponing the decision on the admissibility of the remaining documents until the hearing of the appeal.
Final Decision: The High Court dismissed the revision petition but directed the appellate court to reconsider its order as regards the re-examination of the witness along with the matter of the admissibility of the remaining documents.
