The petitioner has preferred this misc. petition under section 482 of Cr.P.C., 1973 against the order dated 21.04.2017 passed by RHJS Additional Sessions Judge Bhadra Hanumangarh in Criminal Misc. Case No.40/2017 whereby application under section 451 of Cr.P.C., 1973 filed by the petitioner in Session Case No.25/2016 arising out of FIR No.153/15, P.S. Gogamedi to release pick up van RJ 31GA1663 on Supardiganama has been dismissed, to set aside the same offence under Section 8/15,25,29 of NDPS Act.
2. Learned counsel for the petitioner submits that the matter is squarely covered by the judgment rendered by this Court in Satvinder Singh v. State of Rajasthan (Criminal misc. Petition No. 1188/2017) decided on 16.05.2017.
3. This Court on 16.05.2017 has passed the following order in Satvider Singh v. State (Supra):-
1. The petitioner has preferred this criminal misc. petition under Section 482 Cr.P.C., 1973 against the order dated 11.04.2014 passed by learned Special Judge, NDPS Act Cases, Pratapgarh in connection with FIR No.34/2017 Police Station Dhamotar.
