Honble PANCHAL, CJ.–By filing this public interest litigation under Article 226 of the Constitution, the petitioner has prayed to set aside the Memorandum of Understanding (MoU, for short) dated July 04, 2005 executed between the Government of Rajasthan and M/s. Mahindra and Mahindra Limited, a Company incorporated under the provisions of the Companies Act, 1956, for setting up Special Economic Zone (SEZ, for short) on a land admeasuring 3000 acres situated near Mahapura, Ajmer Road, Jaipur. The petitioner has further prayed to set aside the decision dated September 5, 2005 of the Government of Rajasthan by which the Jaipur Development Authority (JDA, for short) as granted approval to transfer the land admeasuring 161.23 hectares to the Rajasthan State Industrial Development & Investment Corporation Limited (RIICO, for short) for the purpose of setting up SEZ. The petition has also prayed to set aside Lease Deed dated September 26, 2006 executed by JDA in favour of RIICO for the purpose of establishment of SEZ. The petitioner has further prayed to set aside the notification dated December 20, 2005 issued under Section 4(1) of the Land Acquisition Act, 1894 (Act of 1894, for short)
