HIGH COURT OF JUDICATURE FOR RAJASTHAN BENCH AT JAIPUR
MAHENDAR KUMAR GOYAL, BHUWAN GOYAL
State Of Rajasthan, Through Its Principal Secretary – Appellant
Versus
Anuj Singh Parma Son Of Shri Narendra Singh Parmar – Respondent
ORDER :
Learned counsels for the respective parties submit that the issue involved herein is no more res integra and stands covered by the judgment dated 18.09.2025 by a co-ordinate Bench of this Court at Principal Seat, Jodhpur passed in the case of State of Rajasthan and Others vs. Deepesh Mudgal and Another and other connected matters whereby, the special appeals writ involving identical controversy have been dismissed.
In view thereof, these special appeals are also dismissed.
Pending application(s), if any, also stands disposed of accordingly.
The court affirmed that similar legal issues have been resolved by prior judgments, ensuring consistency in judicial decisions.
The principle of res integra applies when an issue has been conclusively resolved by a higher court, obligating lower courts to follow that precedent.
The principle of stare decisis mandates that courts follow established precedents in resolving similar legal issues.
A procedural order calling for pleadings from parties does not constitute a judgment under Chapter VIII R.5 and is not appealable.
