Bhawani Singh, J.—These petitions, by the petitioners, arise out of the same incident. Although the extent of punishment varies marginally, however, the substances of the case remains unchanged. Therefore, both these petitions are being taken up together for decision by a common judgment. 2 The facts are that Dr. V.P. Lakhanpal, Professor and Head, Department of Orthopaedics, Indira Gandhi Medical College, Simla, made a written complaint on 28-10-1988 alleging that on the night of 26-10-1988 certain students, namely, Dr. Kapila and Dr Bhupesh Gupta (both interns), Mr Naroo and Mr. Narinder Singh Gill (students) of the college came to his place in doctors residence in Corestorphen Estate at about 10.30 p.m. and abused him. Further, it was complained that Dr. Bhupesh Gupta also threatened him with physical violence and he was joined by Dr. Kapila in showering abuses and to mention the language of the abuses would be to cross the limits of human decency.
