By way of the present application, filed under Section 483 of the Bharatiya Nagarik Suraksha Sanhita, 2023 (hereinafter referred to as ‘BNSS’), applicant-Jhudu Ram has sought his release, on bail, during the pendency of the trial, in case FIR No.136 of 2022, dated 18.10.2022, registered under Section 20 of the Narcotic Drugs & Psychotropic Substances Act (hereinafter referred to as the ‘NDPS Act’), with Police Station Banjar, District Kullu, H.P.
2. According to the applicant, he is in judicial custody in connection with the aforesaid case, which has been termed by him as ‘false’, for allegedly possessing 3.115 kg of charas.
3. The applicant is stated to be the permanent resident of the address, as mentioned in the application.
4. It is the case of the applicant that the story of the prosecution is not confidence inspiring. According to the applicant, the evidence, which has been collected by the Investigating Officer, during investigation, is not reliable, admissible or sustainable in the Court of law.
