This appeal is preferred against the order dated 19th September, 1996 passed by the learned single Judge, Dismissing W.P. No.13673 of 1996. Hence, the petitioner therein has come up in the appeal.
2. In the writ petition, the petitioner has sought for quashing the impugned order dated 19. 1996 hearing number 943/T.P.2/96 passed by the Commissioner of Police, Chennai, in exercise of his power under Sec.41(l) of the Madras City Police Act, 1888 (hereinafter referred to as the ‘Act’).
3. Learned single Judge has dismissed the writ petition at the stage of preliminary hearing, on taking a view that the request for holding a public meeting on 22nd September, 1996 was also made by another group at the same time and same place, therefore the Commissioner of Police was justified in refusing the permission to held the meeting at Seerani Argangam on 29. 1996, in order to avoid conflict between the two groups and thereby resulting in disturbance of breach of peace.
