1. driver of a lorry, sustained injuries. He was treated in various hospitals. He claimed compensation of Rs.3,00,000/-. The claim was made only against the Insurance Company. On evaluation of pleadings and evidence, the Claims Tribunal held that the Insurance Company is liable to pay compensation and quantified the same at Rs.1,65,000/- with interest at the rate of 7.5% per annum. Challenging the liability, fastened on the Company to pay the abovesaid compensation, the present appeal has been filed.
2. Facts morefully set out in the claim petition are as follows:
That on 29.09.2009, about 10.50 A.M., the respondent/claimant came from Coimbatore, taking T.V. Sets in his lorry, bearing Registration No.TNW 6507, to Mummy-Daddy TV Showroom, Kamarapalayam and parked his vehicle, near the showroom. When he removed and rolled down the tarpaulin cover, he accidentally fell down from a stationary vehicle, resulting in injuries, in the left temporal parietal region, tenderness over left side of the chest and fractures of left side ribs 2 to 8.
