Judgment :

This writ petition has been filed by the petitioner praying for issuance of a writ of Certiorarified Mandamus to call for the records pertaining to the order, dated 25-06-2013, vide proceedings in Ni.Mu.4861/2012(A1) passed by the 2nd respondent and to quash the same and consequently, to direct the 3rd respondent to delete the name of the 4th respondent from the patta in respect of S.Nos.312/2 and 312/3, Keezhamabur Village, Ambasamudram Taluk, Tirunelveli District, so as to restore the same in its original position as in patta Nos.217 & 622.

2. The brief facts, which are necessary to decide the issues involved in this writ petition, are as follows :-

2(a) According to the petitioner-Trust, the land measuring to an extent of 81 ½ cents in S.No.312/2 and the land measuring to an extent of northern 36 cents out of 72 cents in S.No.312/3 belong to them-Trust. Patta No.217 relates to the land in S.No.312/2 and Patta No.622 relates to the land in S.No.312/3.

2(b) Originally, the land in S.No.312/2 and other adjacent properties in Keezhambaur Village, Ambasamudram Taluk, Tirunelveli District, belonged to one Valliammal. On 22.07.1939, she executed three sale deeds, in favour of
