JUDGMENT :
(Prayer: Criminal Revision Case has been filed under Section 397 r/w 401 of the Criminal Procedure Code, to call for the records relating to the case in C.A.No.84 of 2010 on the file of the Mahalir Fast Track Court, Nagercoil and set aside the conviction and sentence dated 20.10.2015 confirming the judgment dated 30.09.2010 made in C.C.No.187 of 2008 on the file of the Judicial Magistrate No.1, Nagercoil and acquit the petitioner by allowing this revision case.)
1. This revision petitioner was found guilty by the trial Court as well as by the appellate Court for the offence under Sections 457 and 380 IPC and aggrieved over same, the present revision petition has been filed.
2. The petitioner was tried for the offence under Sections 457 and 380 IPC before the learned Judicial Magistrate No.I, Nagercoil in C.C.No.187 of 2008 and the trial Court by order dated 30.09.2010 found this petitioner guilty for the offence under Sections 457 and 380 IPC, convicted and sentenced him to undergo simple imprisonment for six months with fine of Rs.200/- in default to undergo, one month simple imprisonment for the offence under Section 457 IPC; and to undergo simple imprisonment for six mon
