JUDGMENT :

Prayer: Second Appeal is filed against the judgment and decree dated 24.03.2008 passed by the Subordinate Judge, Kallakurichi in A.S. No. 9 of 2005, confirming the judgment and decree, dated 27.10.2004, passed by the Additional District Munsif No. II, Kallakurichi in O.S. No. 422 of 2002.

1. This second appeal is filed by the plaintiffs in the suit as against the judgment and decree dated 24.03.2008 passed by the Subordinate Judge, Kallakurichi in A.S. No. 9 of 2005, confirming the judgment and decree, dated 27.10.2004, passed by the Additional District Munsif No. II, Kallakurichi in O.S. No. 422 of 2002, which was one for declaration of title and permanent injunction.

2. The appellants herein are the plaintiffs and the respondents are the defendants in the suit. The suit was filed by the appellants/plaintiffs seeking declaration of title and permanent injunction, restraining the respondents/defendants from interfering with their peaceful possession and enjoyment of the suit scheduled properties.
