JUDGMENT :

1. This second appeal is directed as against the judgment and decree dated 24.07.1997 passed in A.S. No. 14 of 1996 on the file of the Principal Subordinate Court, Mayiladuthurai, confirming the judgment and decree dated 14.12.1995 made in O.S. No. 79 of 1994 on the file of the District Munsif Court, Sirkali.

2. For the sake of convenience, the parties are referred to as per their ranking in the trial Court.

3. The case of the plaintiff in brief is as follows:-

3.1. The suit is filed for recovery of possession in respect of A schedule property and for the recovery of money and future profits and for the relief of permanent injunction in respect of B schedule property. The suit properties belonged to the plaintiff comprised in Survey No. 462 and sub divided as 462/2 situated at No. 38, thandavankulam Vattam, Sirkali Taluk, Mayiladuthurai District, ad measuring 41 cents and 2.34 acres respectively. Originally, the husband of the first defendant and the father of the defendants 2 to 5 one K. Jayaraman had taken the A schedule property for lease from the plaintiff for the period from 01.01.1964 to 31.12.1966 i.e., for three years, for running middle school
