(Prayer: Writ Appeal filed under Clause 15 of Letters Patent to set aside the judgment dated 14.11.2019 in W.P.No.5874 of 2017 by allowing this Appeal.)

This Writ Appeal has been filed, challenging the order dated 14.11.2019, passed by the learned Single Judge in W.P.No.5874 of 2017, in and by which, the suspension of the Writ Petitioner was ordered to be revoked, with a direction to reinstate him in a non-sensitive post.

2. For the sake of brevity, the parties are referred to by their original nomenclature in this Writ Appeal as “Appellants and the Writ Petitioner” in this judgment.

3. It was averred by the Appellants that pursuant to the involvement of the Writ Petitioner in a criminal case in Crime No.2 of 2014 for an offence under Sections 7, 13(2) r/w 13(1)(d) of the Prevention of Corruption Act, 1988 for demanding and acceptance of bribe amount of Rs.1,500/, he was arrested and remanded to judicial custody. Consequent to the arrest and remand, he was placed under deemed suspension and aggrieved by the suspension, he filed a Writ Petition in W.P.No.5874 of 2017.
