JUDGMENT

(Prayer: Criminal Original Petition filed under Section 482 of the Criminal Procedure Code, to call for the records pertaining to the impugned charge sheet in C.C.No.267 of 2021 pending on the file of the learned Judicial Magistrate No.1, Nagercoil, Kanyakumari District and quash the same.)

1. This Criminal Original Petition has been filed, invoking Section 482 Cr.P.C., seeking orders to call for the records pertaining to the impugned charge sheet in C.C.No.267 of 2021 pending on the file of the learned Judicial Magistrate No.1, Nagercoil, Kanyakumari District and quash the same.

2. The case of the prosecution is that the petitioners, in a drunken mode, abused the defacto complainant, threatened him with dire consequences and attacked him. They have also damaged the two wheeler of the defacto complainant.

3. The learned counsel appearing for the petitioners would submit that the second respondent has lodged a complaint before the first respondent and on that basis, FIR came to be registered in Crime No.16 of 2019 and after investigation and filing of the final report, the same was taken cognizance in C.C.No.267 of 2021 on the file of the Judicial Magistrate No.1, Nagercoil, Ka
