IN THE HIGH COURT OF MADRAS, (MADURAI BENCH)
ABDUL QUDDHOSE, J.
N.S. Godwin - Petitioner
Versus
The Deputy General Manager, IREL (India) Limited (formerly Indian Earths Limited), Kanyakumari Dist. and Anr. – Respondents
W.P.(MD)No.17744 Of 2021
Decided On : 28-08-2024
For the Petitioner: Mr. R. Karuppiah.
For the Respondents: Mr. C. Muthusaravanan for M/s.Ramasubramanian Associates.
IMPORTANT POINT
A writ petition becomes infructuous when the relief sought pertains to a past event, and if the respondents indicate no intention to conduct similar future events, the court will dismiss the petition.
Headnote:
INFRUCTUOUS - WRIT PETITION - The court dismissed the writ petition as infructuous since the examination sought by the petitioner was for October 2021, which had already passed. The court noted the respondents' intention not to hold similar examinations in the future, influencing the decision to dismiss the case without costs.
Fact of the Case:
The petitioner filed a writ petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to allow him to complete his training and sit for an examination scheduled for October 2021.
Finding of the Court:
The court found that the prayer made by the petitioner had become infructuous due to the passage of time and the respondents' indication that they would not conduct similar examinations in the future.
Issues: Whether the writ petition could be maintained given that the examination date had passed and the respondents had no intention of conducting similar examinations.
Ratio Decidendi: The court held that a writ petition seeking relief for an examination that had already occurred is not maintainable, and the lack of future examinations rendered the petition moot.
Result: The writ petition was dismissed as infructuous, with no order as to costs.
ORDER :
(Prayer : Writ Petition filed under Article 226 of the Constitution of India, praying for a Writ of Mandamus, directing the respondents to permit the petitioner to complete his further training period and to write examination to be conducted in October 2021 by Regional Directorate of Apprenticeship Training.)
The prayer sought for by the petitioner in this Writ Petition has now become infructuous, since the examination which the petitioner wants to write pertains to October, 2021.
2. It is also represented by learned Standing Counsel appearing for the respondents that in the near future, the respondents do not desire to hold similar examinations as the one for which relief is sought for in this writ petition. The said statement made by the respondent Counsel, on instructions is recorded.
3. In view of the fact that the prayer sought for by the petitioner has become infructuous, since the examination pertains to October, 2021, this Writ Petition is dismissed as infructuous, after recording the submission made by the learned Standing Counsel for the respondents, on instructions that in the near future, the respondent is not desirous of holding a similar examination as to the one for which the petitioner is seeking a relief in this Writ Petition. There shall be no order as to costs.
