IMPORTANT POINT
A writ petition can be dismissed as infructuous if the underlying issue is no longer relevant or necessary.
Headnote:
Writ Petition - Mandamus - The court dismissed the writ petition as infructuous, indicating that the request for permission to conduct the Manjuvirattu event was no longer relevant or necessary, as acknowledged by the petitioner's counsel.
Fact of the Case:
The petitioner filed a writ petition under Article 226 of the Constitution of India seeking a Writ of Mandamus to direct the second respondent to grant permission for conducting the Manjuvirattu event on a specified date, including their village in the district gazette.
Finding of the Court:
The court noted that the learned counsel for the petitioner stated that the writ petition had become infructuous and made an endorsement to that effect in the court bundle.
Issues: Whether the writ petition for conducting the Manjuvirattu event was still relevant and necessary.
Ratio Decidendi: The court concluded that since the petitioner's counsel indicated the writ petition was infructuous, it was appropriate to dismiss the petition without further consideration.
Result: The Writ Petition was dismissed as infructuous, with no order as to costs.
