IMPORTANT POINT
The court established that a Will must be executed in accordance with the provisions of the Indian Succession Act, requiring attestation and confirmation of the testator's mental capacity.

Headnote:

PROBATE - INDIAN SUCCESSION ACT - The court granted probate for the Will dated 08.07.2021 of Mrs. Vijaya Srinivasan, emphasizing the importance of attestation and sound mind during execution. The consent of legal heirs and evidence from attesting witnesses supported the validity of the Will, leading to the court's decision to allow the petition.

Fact of the Case:

The petitioner sought probate for the Will of Mrs. Vijaya Srinivasan, who passed away on 02.12.2022. The first respondent, her husband, died during the proceedings, and both daughters consented to the petition.

Issues: Whether the Will dated 08.07.2021 was validly executed and whether probate should be granted.
