This is an appeal challenging order dated 07.07.2025, of learned Additional Sessions Judge, Fast Track Special Court, Rewari, declining the prayer of regular bail of the appellant.
2. On behalf of the appellant/child-in-conflict with law (hereinafter referred to as 'CCL'), it has been argued that he had been falsely implicated in the case and the only role attributed to him was that he had taken the prosecutrix along with him on a motorcycle. It has been submitted that the prosecutrix, her father and grand father had been examined during trial but they did not support case of the prosecution. This material fact was completely overlooked by the learned Additional Sessions Judge, Fast Track Special Court, Rewari, while declining the bail application, as also the fact that the appellant was in custody for the last more than two years and no recovery was effected from his possession. It was, thus, prayed that the appellant be enlarged on bail by setting aside the impugned order.
