Hon’ble Naheed Ara Moonis, J.—The aforesaid appeals are directed against the common judgment and order dated 22.12.1981 passed by the learned Vth Additional Sessions Judge, Shahjahanpur in S.T. No. 204 of 1981 arising out of case Crime No. 117 of 1981, under Sections 147, 148, 149, 302, 201 and 120-B I.P.C., police station Tilhar, district Shahjahanpur whereby the appellants Ram Saran, Puttu and Ram Bharosey of the Criminal Appeal No. 146 of 1982 have been convicted under Section 148 I.P.C. for one year rigorous imprisonment, under Section 302/149 I.P.C. to undergo imprisonment for life and under Section 201/149 I.P.C. For two years rigorous imprisonment. The appellants Ved Pal and Rishi Pal of the connected Criminal Appeal No. 472 of 1982 have been sentenced to undergo one year rigorous imprisonment under Section 147 I.P.C., under Section 302/149 I.P.C. to undergo life imprisonment and under Section 201/149 I.P.C. for two years rigorous imprisonment. All the sentences were directed to run concurrently. The co-accused Radhey who has not been found guilty of offence punishable under Sections 147, 302/149 and 201/149 I.P.C. has been acquitted by the trial Court.
