Committee of Management of Kanpur Vidya Mandir Mahila (Post Graduate) College, Swaroop Nagar, Distt. Kanpur Nagar through its Secretary Dr. Dinesh Chandra Gupta is before this Court assailing the validity of the order dated 20.11.2015 passed by learned Single Judge in Writ Petition No.63521 of 2015. The order passed by learned Single Judge reads as follows: -

"Learned standing counsel has accepted notice on behalf of respondents no.1, 2 and 4 to 6, Sri Neeraj Tiwari on behalf of respondent no.3 and Sri G.K. Singh, learned senior counsel assisted by Sri V.K. Singh on behalf of respondent no.7.

Issue notice to respondent no.8 fixing a date in the week commencing 14.12.2015.

Steps to be taken within a week by registered post.

All the respondents to file their counter affidavit before the next date fixed.

Stay application shall be considered after exchange of affidavits."

2. On the matter being taken up today, Shri Ashok Khare, Sr. Advocate appearing along with Shri Irshad Ali, Advocate submitted before us that the case in hand was one, wherein interim order ought to have been passed by learned Single Judge on the first day instead of deferring the matter on the said date and proceed
