Union Of India Thru. Secy. Ministry Of External Affairs Govt. Of India, New Delhi And Others - Respondent
Writ - C No. - 6971 of 2022
Decided On : 11-10-2022
Passport Issuance - Personal Liberty - The court considered the re-issuance of a passport that had expired and the impact of Section 6(2)(f) of the Passport Act, 1967 on the petitioner's personal liberty. The court highlighted the exemption conditions for citizens with pending criminal proceedings and the necessity of court orders for passport issuance.
Fact of the Case:
The petitioner's personal liberty is the subject matter of contest in a writ petition, and the arrest has been stayed pending investigation. The petitioner seeks re-issuance of an expired passport.
Finding of the Court:
The court held that the writ petition cannot be entertained as an independent cause for the relief sought, and the legality of Section 6(2)(f) remains intact based on a previous judgment. The petitioner was given liberty to make an application in the pending writ petition.
Issues: The main issue was the re-issuance of the expired passport and its relation to the petitioner's personal liberty. Additionally, the legality of Section 6(2)(f) was considered.
Ratio Decidendi: The court emphasized that the issuance of a passport is a part of personal liberty protected under Article 21 of the Constitution of India. It also highlighted the exemption conditions for citizens with pending criminal proceedings and the requirement of court orders for passport issuance.
Final Decision: The writ petition was disposed of with liberty open to the petitioner to make an application in the pending writ petition.
