Hon'ble Shamim Ahmed, J.
1. Heard Sri Ashutosh, learned counsel for the applicant, Sri Ashok Kumar Singh, learned A.G.A.-I for the State and perused the record.
2. In view of the order proposed to be passed, notice to opposite party No.2 is hereby dispensed with as purely legal question is involved in this case, however, learned A.G.A-I for the State has accepted notice on behalf of State-opposite party No.1.
3. The instant application under Section 482 Cr.P.C. has been filed on behalf of the applicant seeking direction to be to the trial court to accept 20% amount in Criminal Appeal No.82 of 2024 relating to Complaint Case No.2212/2017 under Section 138 of Negotiable Instruments Act, 1881, Police Station-Gomti Nagar, District-Lucknow.
4. Learned Counsel for the petitioner submits that initially, the present opp. party no. 2 filed a complaint U/S 138 of Negotiable Instruments Act, 1881 against the applicant in the Court of learned Presiding Officer Special Court, NI Act, Lucknow on 02.05.2017 with allegations that the opposite party No.2 and applicant came in contact and the applicant promised him to sell a plot ad measuring 2000 square feet, Village Amrai Indira Nagar, Luckn
