1. By means of present Application under Section 482 Cr.P.C., the applicant seeks to quash the impugned orders dated 08.03.2017 and 09.03.2017, passed by respondent no.2 against the applicant in Sessions Trial No. 11 of 2016, State vs. Bholu @ Rocky @ others, pending before 1st Additional District & Sessions Judge, Roorkee, under section 302 IPC.
2. In earlier petition under Section 482 Cr.P.C. (C-482 Petition No. 1636 of 2016), following order was passed by Hon’ble Coordinate Bench of this Court on 16.12.2016:
“Learned counsel for the petitioner prays for and is permitted to withdraw the present petition.
The petition is dismissed as withdrawn with liberty reserved to the petitioner to move a bail application before the Trial Court and the Trial Court shall consider the bail application preferably on the same day, when it is file before it, after putting the Government Advocate through notice.”
3. This is the 2nd 482 Cr.P.C. petition filled on behalf of the applicant being aggrieved against framing of charge under Section 302 IPC read with Section 34 IPC. Written objections were filed on behalf of the applicant before the Trial Court to show that no charge should be framed a
