The case is heard finally.
This is the first bail application filed by the applicant under Section 439 of the Cr.P.C. for grant of bail. The applicant is in custody since 27.06.2014 in connection with Criminal Case No. 27624 of 2006 registered by Judicial Magistrate First Class, Jabalpur for the offence punishable under Section 138 of IPC.
2. Learned counsel for the applicant submits that the applicant has been falsely implicated in this case. It is further submitted by learned counsel for the applicant that the applicant is earning member of his family and remains in jail for a long time his family members will be hand to mouth. The applicant is in custody since 27.06.2014 and trial would take considerable time to conclude, therefore, he may be released on bail.
3. On due consideration of the contentions raised in the application, nature of allegation against the applicant, and overall facts and circumstances of the case, I am of the considered view that it is a fit case to release the applicant on bail, therefore, without expressing any view on the merits of the case, the application is allowed and it is directed that the applicant Rajesh Ku
