JUDGMENT
1. This is the first bail application u/S.439 Cr.P.C filed by the applicant for grant of bail.
2. Applicant has been arrested on 8/4/2020 by Police Station Bhitarwar District Gwalior (M.P.) in connection with Crime No.95/2020 registered for offence under Sections 147, 148, 149, 307, 353, 186, 188, 336 and 332 of Indian Penal Code, 1860.
3. Learned counsel for the applicant- Kalla Gurjar has submitted that this is the first bail application of the present applicant under Section 439 of CrPC. The applicant is in custody since 8/4/2020. The case is registered under Sections 147, 148, 149, 307, 353, 186, 188, 336 and 332 of IPC. The complainant is the Tahsildar who has lodged the FIR. The FIR has been registered against around 50 persons. There is no specific injury found in the MLC which may attract offence under Section 307 of IPC and there are only simple injuries.
4. The matter relates to stone pelting by group of persons. There is no specific overt act done by the present applicant.
