JUDGMENT
Gurpal Singh Ahluwalia, J. - This fourth application under Section 439 of Cr.P.C. has been filed for grant of bail. Third application was dismissed as withdrawn by order dated 22.07.2022 passed in MCRC No.35796/2022.
2. The applicant has been arrested on 09.02.2022 in connection with Crime No.31/2022 registered at Police Station Bilauva for offence under Sections 324, 454, 380, 394 of IPC and 11/13 MPDVPK Act.
3. The second bail application was dismissed by order dated 11.05.2022 passed in MCRC No.23613/2022 with liberty to revive the prayer after the examination of the complainant/victim. It is fairly conceded that the victim has not been examined so far.
4. Accordingly, counsel for the applicant seeks permission of this Court to withdraw this application with liberty to revive the prayer after examination of the victim.
5. With aforesaid liberty, the application is dismissed as withdrawn.
