1. The petitioner has filed the present petition, under Article 227 of the Constitution of India, challenging the orders dated 05.10.2017 as well as dated 13.09.2017 passed by the trial Court.
2. At the time of the argument, learned counsel for the petitioner submits that he does not want to press this petition so far as, the order dated 05.10.2017 is concerned.
3. Accordingly, the petition is dismissed as withdrawn in respect of order dated 05.10.2017.
4. The petitioner has filed the present petition, under Article 227 of the Constitution of India, challenging the order dated 13.09.2017 passed by 12th Civil Judge Class-II, Bhopal in RCS No. 488-A/2016 by which the trial Court has dismissed the application preferred by the petitioner under Section 10 of the C.P.C.
5. The petitioner/defendant has filed a suit for specific performance of contract which was registered as RCS No. 462-A/2016.
